1. Parties and subject

This agreement is between EskicyStudio on one side and the person using the WaiPlan mobile app and website (the "User") on the other. EskicyStudio's full identity and address are listed in the Contact section at the end.

It sets out the conditions under which WaiPlan is offered and the rights and obligations of both parties.

These terms only cover how the app may be used. How personal data is processed is explained separately in the Privacy Notice (KVKK); that notice is for information, not for approval. Optional processing is handled through the Explicit Consent text.

2. Definitions

• App: the WaiPlan mobile app distributed on the App Store and Google Play (package com.eskicy.waiplan) and the related pages on waiplan.com.
• Guest Account: the anonymous account automatically created for your device the first time the App is opened, without asking you for any information.
• Account: the sign-in you connect with email and password, or with Apple or Google.
• Trip Plan: the day-by-day itinerary the App generates from the destination, dates and preferences you provide, including places, times, transport steps and weather information.
• User Content: the trips, preferences, saved places and plan edits you enter in the App.
• Premium: the features unlocked by the paid subscription (WaiPlan Premium).
• AI Features: features that generate plans from your trip details, such as generating a Trip Plan, re-planning a day and suggesting alternative places.

3. What the service is

WaiPlan is a travel planning tool. From the destination, dates and preferences you provide, it prepares a day-by-day plan made of real places, tries to take walking and public transport between stops, opening hours and weather into account, and shows the plan as a list and on a map.

What the App is not is also part of these terms:

• WaiPlan is not a travel agency, tour operator or booking intermediary. No tickets, hotels, tours or admissions are sold and no reservations are made through the App.
• Places, opening hours, prices, travel times and weather forecasts in a plan come from third-party sources and estimates; they can change or be wrong.
• The App does not give visa, health, safety or legal advice. Checking official sources before you travel is your responsibility.

4. Guest use, accounts and age

The App starts with a Guest Account. A Guest Account is tied to the device: if the App is deleted, the device changes or you sign out, the trips in the guest account can no longer be reached. To keep your data, you can connect an Account from the Profile screen; your guest trips and saved places then move to that Account.

You must give accurate, current information when connecting an Account. An account belongs to one person and must not be shared.

Age requirements:

• The App is not designed for, and may not be used by, children under 13.
• Users under 18 may use the App, and in particular the paid subscription, only with the knowledge and permission of a parent or guardian.

5. Your obligations

You agree to:

• Keep your account details and password confidential; you are responsible for activity on your account.
• Use the App in line with the law, these terms and good faith.
• Not reverse-engineer the App, bypass its security, overload it with automated tools, bulk-extract plan or place data, or resell the service.
• Not unlock paid features through fraud, fake purchases or methods meant to bypass usage limits.
• Follow plan suggestions with due regard for your own safety, local rules and weather conditions.

6. AI features and accuracy of plans

Trip Plans are generated with the help of an AI model (Gemini on Google Vertex AI) from the information you provide (destination, dates, travel group, pace, interests, budget and transport preferences) and candidate place data. Your name, email address or account details are not sent to the AI.

• Generated plans may contain wrong, incomplete or outdated information. Opening hours, closing days, admission fees, reservation requirements, travel times and weather forecasts can change. Check details with the official source of a place, especially before time-bound or paid visits.
• Opening hours marked as "verified" reflect third-party data at the time it was checked; they are not guaranteed to stay the same.
• Generating, re-planning and saving plan edits require Premium and use credits from a weekly and a monthly allowance. A trip can be up to 7 days long. Current limits and costs are shown on the purchase screen and on the Usage page in your Profile. Unused credits do not carry over.
• AI Features are the core of the service; processing your trip details when you ask for a plan is necessary to perform this agreement. Details are in the Privacy Notice.

7. Maps and third-party content

The App uses Google Maps Platform services for maps, places, routes and weather. By using the Google Maps features in the App you are also bound by the Google Maps / Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps/) and the Google Privacy Policy (https://policies.google.com/privacy).

Some place descriptions and photos come from open data sources such as OpenStreetMap, Wikipedia, Wikidata and Wikimedia Commons and are subject to their licences. Sources and attributions are shown in the App and at waiplan.com/credits.

EskicyStudio is not responsible for the accuracy or availability of third-party content.

8. Paid subscription (WaiPlan Premium)

Premium is purchased as a monthly or yearly subscription through the store the App was installed from (Apple App Store or Google Play).

• The current price, period, usage limits (credits) and any free trial defined in the store are shown on the purchase screen.
• The subscription renews automatically for the same period (every month or every year) unless cancelled at least 24 hours before the renewal date. The renewal is charged to the payment method of your store account.
• Cancel in the subscription settings of the store you bought from. After cancelling you keep Premium until the end of the paid period.
• Deleting your account does not end the store subscription. For that reason an account cannot be deleted on the website while a subscription is still renewing; cancel it in the store first.
• Refunds are governed by the refund policy of the store that charged you (Apple or Google). EskicyStudio does not collect payments directly and cannot issue refunds itself, but will help with your request.
• A free trial converts to a paid subscription unless cancelled before it ends.
• Prices may change for future periods. A change never applies to the current period and is announced by the store before renewal.
• If a plan fails to generate for a technical reason, the allowance used for it is returned to you.

Right of withdrawal: the subscription is digital content supplied immediately. Under Article 15 of the Turkish Distance Contracts Regulation, the right of withdrawal does not apply once supply has started with your consent. This does not remove any rights you have under the stores' own refund policies.

9. Intellectual property

The App's software, interface design, logo, images, texts and brand belong to EskicyStudio. These terms only give you the right to use the App for personal, non-commercial purposes; they do not allow copying, distribution, derivative works or access to source code.

You may freely use and share the Trip Plans generated for your own personal travel. Third-party content in plans (maps, photos, place data) remains under its own licences.

10. User Content

User Content belongs to you. EskicyStudio claims no ownership of it.

So that the service can work, you allow EskicyStudio to store, back up, sync across your devices and process User Content at your request (for example to generate a plan), only for the purpose of providing the App to you. This permission:

• does not cover using User Content for advertising,
• does not cover selling it to third parties or sharing it for marketing,
• ends when the account is deleted or the content is removed.

11. Changes, interruptions and suspension

EskicyStudio may improve, change or remove features. The service may be interrupted for maintenance, updates, failures of infrastructure or data providers, or force majeure.

Older versions of the App may stop being supported for security or compatibility reasons. In that case the App asks you to update from the store before you can continue.

In case of a clear breach of these terms, EskicyStudio may suspend or close the account in proportion to the severity of the breach.

12. Limitation of liability

The App is provided "as is". EskicyStudio does not promise uninterrupted or error-free service.

EskicyStudio is not liable for losses arising from a place in a plan being closed, changed hours, prices or transport information, missed connections, weather, your device or internet connection, outages of third-party providers, or use of the App contrary to these terms.

These limits do not affect mandatory consumer protection rules or liability for intent or gross negligence.

13. Termination and account deletion

You can delete your account at any time:

• In the App: Profile → Delete account
• On the website: waiplan.com/delete-account

Deleting the account removes its trips, plans, saved places, preferences and consent records; it cannot be undone. Deletion on the website is not possible while a subscription is renewing; cancel it in the store first.

14. Changes to these terms

These terms may be updated. Every update carries a version number and an effective date.

When a change affects your rights or obligations, the new version is shown when you open the App and you must accept it to continue. For changes that do not affect the substance, the new version is announced in the App but you can continue without accepting it again. If you do not want to accept a new version, you can end the agreement by deleting your account.

Your account records which version you accepted and when.

15. Governing law and disputes

These terms are governed by Turkish law. The Turkish text is binding; versions in other languages are for information.

The courts and enforcement offices of İstanbul have jurisdiction. If you are a consumer, your right to apply to the Consumer Arbitration Boards and Consumer Courts of your place of residence, within the applicable monetary limits, is reserved. Consumers resident in the EU or elsewhere also keep any mandatory protections of their local law.

1. Taraflar ve sözleşmenin konusu

Bu sözleşme, bir tarafta EskicyStudio, diğer tarafta WaiPlan mobil uygulamasını ve web sitesini kullanan kişi (bundan sonra "Kullanıcı") arasındadır. EskicyStudio'nun açık kimlik ve adres bilgileri sözleşmenin sonundaki İletişim bölümünde yer alır.

Sözleşmenin konusu, WaiPlan'ın Kullanıcı'ya hangi şartlarla sunulduğu ve tarafların karşılıklı hak ve yükümlülükleridir.

Bu metin yalnızca uygulamanın kullanım şartlarını düzenler. Kişisel verilerin nasıl işlendiği ayrı bir belgede, KVKK Aydınlatma Metni'nde açıklanır; aydınlatma metni bir onay belgesi değil, bilgilendirme belgesidir. İsteğe bağlı veri işleme faaliyetleri ayrıca Açık Rıza Metni ile yönetilir.

2. Tanımlar

• Uygulama: WaiPlan adlı, App Store ve Google Play üzerinden dağıtılan mobil uygulama (paket adı com.eskicy.waiplan) ve ona bağlı waiplan.com web sayfaları.
• Misafir Hesap: Uygulama ilk açıldığında, Kullanıcı'dan herhangi bir bilgi istenmeden cihaz için otomatik oluşturulan anonim hesap.
• Hesap: Kullanıcı'nın e-posta ve şifre ile ya da Apple / Google ile giriş yaparak bağladığı kayıt.
• Seyahat Planı: Kullanıcı'nın verdiği destinasyon, tarih ve tercihlere göre uygulamanın ürettiği gün gün güzergâh; içindeki yerler, saatler, ulaşım adımları ve hava durumu bilgileri.
• Kullanıcı İçeriği: Kullanıcı'nın uygulamaya girdiği seyahatler, tercihler, kaydettiği yerler ve planlarda yaptığı düzenlemeler.
• Premium: Uygulamanın ücretli abonelikle açılan özellikleri (WaiPlan Premium).
• Yapay Zekâ Özellikleri: Seyahat Planı üretme, bir günü yeniden planlama ve alternatif yer önerme gibi, Kullanıcı'nın verdiği seyahat bilgilerinden plan üreten özellikler.

3. Hizmetin kapsamı

WaiPlan bir seyahat planlama aracıdır. Kullanıcı'nın verdiği destinasyon, tarih ve tercihlere göre gerçek yerlerden oluşan gün gün bir plan hazırlar; yerler arasındaki yürüyüş ve toplu taşıma adımlarını, açılış saatlerini ve hava durumunu dikkate almaya çalışır ve planı harita ile liste hâlinde gösterir.

Uygulamanın ne olmadığı da bu sözleşmenin parçasıdır:

• WaiPlan bir seyahat acentesi, tur operatörü veya rezervasyon aracısı değildir. Uygulama üzerinden bilet, otel, tur veya giriş bileti satılmaz; rezervasyon yapılmaz.
• Plandaki yerler, açılış saatleri, fiyat bilgileri, ulaşım süreleri ve hava tahminleri üçüncü taraf kaynaklardan ve tahminlerden gelir; değişebilir veya hatalı olabilir.
• Uygulama vize, sağlık, güvenlik veya hukuki konularda danışmanlık vermez. Seyahat öncesinde resmî kaynakları kontrol etmek Kullanıcı'nın sorumluluğundadır.

4. Misafir kullanım, hesap ve yaş şartı

Uygulama ilk açılışta bir Misafir Hesap ile çalışır. Misafir Hesap cihaza bağlıdır: uygulama silinirse, cihaz değişirse veya çıkış yapılırsa misafir hesaptaki seyahatlere bir daha erişilemez. Verilerini korumak isteyen Kullanıcı, Profil ekranından bir Hesap bağlayabilir; bu durumda misafir hesaptaki seyahatler ve kayıtlı yerler bağlanan hesaba taşınır.

Hesap bağlarken doğru ve güncel bilgi vermek gerekir. Bir hesap tek bir kişiye aittir ve başkasıyla paylaşılamaz.

Yaşa bağlı şartlar:

• Uygulama 13 yaşından küçükler için tasarlanmamıştır ve 13 yaşından küçükler tarafından kullanılamaz.
• 18 yaşından küçük Kullanıcılar uygulamayı ve özellikle ücretli aboneliği ancak veli veya vasisinin bilgisi ve izni ile kullanabilir.

5. Kullanıcı'nın yükümlülükleri

Kullanıcı:

• Hesap bilgilerini ve şifresini gizli tutar; hesabı üzerinden yapılan işlemlerden kendisi sorumludur.
• Uygulamayı yürürlükteki mevzuata, bu sözleşmeye ve dürüstlük kurallarına uygun kullanır.
• Uygulamayı tersine mühendislik yoluyla çözmeye, güvenlik önlemlerini aşmaya, otomatik araçlarla aşırı yük bindirmeye, plan ve yer verilerini toplu olarak çekmeye veya hizmeti başkalarına yeniden satmaya çalışmaz.
• Ücretli özellikleri hile, sahte satın alma veya kullanım sınırlarını aşmaya yönelik yöntemlerle açmaya çalışmaz.
• Plan önerilerini kendi güvenliğini, yerel kuralları ve hava koşullarını gözeterek uygular.

6. Yapay zekâ özellikleri ve planların doğruluğu

Seyahat Planları, Kullanıcı'nın verdiği bilgiler (destinasyon, tarihler, seyahat grubu, tempo, ilgi alanları, bütçe ve ulaşım tercihleri) ve aday yer verileri kullanılarak bir yapay zekâ modeli (Google Vertex AI üzerindeki Gemini) yardımıyla üretilir. Yapay zekâya Kullanıcı'nın adı, e-posta adresi veya hesap bilgisi gönderilmez.

• Üretilen planlar hatalı, eksik veya güncel olmayan bilgi içerebilir. Açılış saatleri, kapanış günleri, giriş ücretleri, rezervasyon gereklilikleri, ulaşım süreleri ve hava tahminleri değişebilir. Kullanıcı, özellikle zamana bağlı ve ücretli ziyaretlerden önce bilgileri ilgili yerin resmî kaynağından doğrular.
• Uygulamanın "doğrulandı" olarak işaretlediği açılış saatleri, kontrol edildiği andaki üçüncü taraf verisini yansıtır; değişmeyeceği garanti edilmez.
• Plan üretme, yeniden planlama ve plan düzenlemelerini kaydetme Premium gerektirir ve haftalık ve aylık kredi hakkından düşer. Bir seyahat en fazla 7 gün olabilir. Güncel sınırlar ve kredi maliyetleri satın alma ekranında ve Profil'deki Kullanım sayfasında gösterilir. Kullanılmayan krediler devretmez.
• Yapay Zekâ Özellikleri hizmetin esasını oluşturur; Kullanıcı bir plan üretmeyi istediğinde bu bilgilerin işlenmesi sözleşmenin ifası için gereklidir. Ayrıntılar KVKK Aydınlatma Metni'nde yer alır.

7. Harita ve üçüncü taraf içerikleri

Uygulama, harita, yer, rota ve hava durumu bilgileri için Google Maps Platform hizmetlerini kullanır. Uygulamadaki Google Haritalar özelliklerini kullanan Kullanıcı, Google Haritalar / Google Earth Ek Hizmet Şartları'na (https://maps.google.com/help/terms_maps/) ve Google Gizlilik Politikası'na (https://policies.google.com/privacy) da tabidir.

Yer açıklamaları ve fotoğrafların bir kısmı OpenStreetMap, Wikipedia, Wikidata ve Wikimedia Commons gibi açık veri kaynaklarından gelir ve ilgili lisanslara tabidir. Kaynak ve atıf bilgileri uygulamada ve waiplan.com/credits sayfasında gösterilir.

Üçüncü taraf içeriklerinin doğruluğundan ve sürekliliğinden EskicyStudio sorumlu değildir.

8. Ücretli abonelik (WaiPlan Premium)

Premium, uygulamanın dağıtıldığı mağaza (Apple App Store veya Google Play) üzerinden aylık veya yıllık abonelik olarak satın alınır.

• Güncel fiyat, abonelik süresi, kullanım sınırları (krediler) ve mağazada tanımlıysa ücretsiz deneme süresi satın alma ekranında gösterilir.
• Abonelik, yenileme tarihinden en az 24 saat önce iptal edilmedikçe mağaza tarafından aynı süre için (her ay veya her yıl) otomatik yenilenir. Yenileme ücreti mağaza hesabına bağlı ödeme yöntemine yansır.
• İptal, satın almanın yapıldığı mağazanın abonelik ayarlarından yapılır. İptalden sonra ödenmiş dönemin sonuna kadar Premium kullanılabilir.
• Hesabı silmek mağazadaki aboneliği sonlandırmaz. Bu nedenle yenilenen bir abonelik varken web sitesindeki hesap silme sayfasından hesap silinemez; önce abonelik mağazadan iptal edilmelidir.
• Ücret iadesi talepleri, ödemeyi tahsil eden mağazanın (Apple veya Google) iade politikasına tabidir. EskicyStudio doğrudan tahsilat yapmadığı için iadeyi kendisi gerçekleştiremez; talebe destek olur.
• Ücretsiz deneme süresi, süre dolmadan iptal edilmezse ücretli aboneliğe döner.
• Abonelik ücretleri ileriye dönük olarak değiştirilebilir. Değişiklik yürürlükteki abonelik dönemine uygulanmaz ve yenilemeden önce mağaza tarafından bildirilir.
• Bir planın üretimi teknik bir nedenle başarısız olursa, o plan için kullanılan hak Kullanıcı'ya geri verilir.

Cayma hakkı: Abonelik, elektronik ortamda anında ifa edilen bir dijital içerik hizmetidir. Mesafeli Sözleşmeler Yönetmeliği'nin 15. maddesi uyarınca, Kullanıcı'nın onayıyla ifasına başlanan bu tür hizmetlerde cayma hakkı kullanılamaz. Bu durum, mağazaların kendi iade politikalarından doğan haklarını ortadan kaldırmaz.

9. Fikri mülkiyet

Uygulamanın yazılımı, arayüz tasarımı, logosu, görselleri, metinleri ve markası EskicyStudio'ya aittir. Bu sözleşme Kullanıcı'ya yalnızca uygulamayı kişisel ve ticari olmayan amaçla kullanma hakkı verir; kopyalama, dağıtma, türev çalışma üretme veya kaynak koda erişme hakkı vermez.

Üretilen Seyahat Planlarını Kullanıcı kendi kişisel seyahati için serbestçe kullanabilir ve paylaşabilir. Planlardaki üçüncü taraf içerikleri (harita, fotoğraf, yer bilgileri) kendi lisanslarına tabidir.

10. Kullanıcı İçeriği

Kullanıcı İçeriği Kullanıcı'ya aittir. EskicyStudio bu içerik üzerinde mülkiyet iddia etmez.

Hizmetin çalışabilmesi için EskicyStudio'ya, Kullanıcı İçeriği'ni yalnızca uygulamayı Kullanıcı'ya sunmak amacıyla saklama, yedekleme, cihazlar arasında eşleme ve Kullanıcı'nın talebi üzerine işleme (örneğin bir plan üretme) yetkisi verilir. Bu yetki:

• Kullanıcı İçeriği'nin reklam amacıyla kullanılmasını kapsamaz,
• üçüncü taraflara satılmasını veya pazarlama amacıyla paylaşılmasını kapsamaz,
• hesap silindiğinde veya içerik kaldırıldığında sona erer.

11. Hizmette değişiklik, kesinti ve askıya alma

EskicyStudio özellikleri geliştirebilir, değiştirebilir veya kaldırabilir. Bakım, güncelleme, altyapı veya veri sağlayıcısından kaynaklanan arıza ya da mücbir sebep hâllerinde hizmette kesinti olabilir.

Uygulamanın eski sürümleri, güvenlik veya uyumluluk nedeniyle desteklenmeyebilir. Bu durumda uygulama, kullanıma devam edebilmek için mağazadan güncelleme yapılmasını ister.

Bu sözleşmenin açıkça ihlâli hâlinde EskicyStudio, ihlâlin ağırlığıyla orantılı olarak hesabı geçici olarak askıya alabilir veya kapatabilir.

12. Sorumluluğun sınırı

Uygulama "olduğu gibi" sunulur. EskicyStudio, hizmetin kesintisiz veya hatasız olacağını taahhüt etmez.

EskicyStudio; plandaki bir yerin kapalı olması, saat, ücret veya ulaşım bilgisinin değişmiş olması, kaçırılan bağlantılar, hava koşulları, Kullanıcı'nın cihazı veya internet bağlantısı, üçüncü taraf hizmet sağlayıcılarının kesintisi ya da uygulamanın bu sözleşmeye aykırı kullanılmasından doğan zararlardan sorumlu değildir.

Bu sınırlamalar, tüketici mevzuatının emredici hükümlerini ve kast veya ağır ihmalden doğan sorumluluğu ortadan kaldırmaz.

13. Sözleşmenin sona ermesi ve hesap silme

Kullanıcı hesabını dilediği zaman silebilir:

• Uygulamada: Profil → Hesabı sil
• Web sitesinde: waiplan.com/delete-account

Hesap silindiğinde hesaba bağlı seyahatler, planlar, kayıtlı yerler, tercihler ve onay kayıtları kaldırılır; işlem geri alınamaz. Web sitesinden silme, yenilenen bir abonelik varken yapılamaz; abonelik önce mağaza üzerinden iptal edilmelidir.

14. Sözleşmenin güncellenmesi

Bu sözleşme güncellenebilir. Her güncelleme bir sürüm numarası ve yürürlük tarihi taşır.

Kullanıcı'nın haklarını veya yükümlülüklerini etkileyen önemli bir değişiklik yapıldığında yeni sürüm uygulama açılışında gösterilir ve kullanıma devam etmek için kabul edilmesi istenir. Esasa etki etmeyen değişikliklerde yeni sürüm uygulamada bildirilir ancak kullanıma devam etmek için yeniden kabul gerekmez. Kullanıcı yeni sürümü kabul etmek istemezse hesabını silerek sözleşmeyi sona erdirebilir.

Hangi sürümü ne zaman kabul ettiğin hesabında kayıtlıdır.

15. Uygulanacak hukuk ve uyuşmazlıkların çözümü

Bu sözleşmeye Türk hukuku uygulanır. Sözleşmenin Türkçe metni esastır; diğer dillerdeki metinler bilgilendirme amaçlıdır.

Uyuşmazlıklarda İstanbul Mahkemeleri ve İcra Daireleri yetkilidir. Kullanıcı'nın tüketici sıfatını taşıması hâlinde, parasal sınırlara göre yerleşim yerindeki Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri'ne başvurma hakkı saklıdır.
